By visiting ERP Compass or using the offered service, your personal data will be collected and processed in accordance with the conditions set out in this privacy statement.

Statutory basis

Processing of personal data is only lawful if the processing falls under one of the conditions established in the Regulation1. ERP Compass processes personal data based on explicit permission given by the data subject for the processing of these personal data.

With regard to the processing of personal data for (direct) marketing purposes, ERP Compass takes the position that this processing is necessary to promote the legitimate interests of ERP Compass.

Purpose of processing

Execution of an agreement

If a visitor enters into an agreement with ERP Compass, the personal data provided will be processed in order to properly execute the agreement. The agreement between ERP Compass and the visitor consists of mediating between the visitor and suppliers of software. In addition, ERP Compass will send the visitor an e-mail message with one or more suppliers of software, who will approach the visitor, exclusively at the request of the visitor, with information about the software they supply.

ERP Compass will provide the contact details to a maximum of 7 software suppliers when executing the agreement. The visitor can therefore be contacted by a maximum of 7 suppliers.

Marketing

Contact information provided is used by ERP Compass to approach the person in question with information about the services provided by ERP Compass. Data that ERP Compass collects through your visit to the website are also used to approach these visitors with information about the services provided by ERP Compass.

Product information

ERP Compass will send a whitepaper on request. The contact information provided will also be used to inform the visitor about news items relating to the service or developed products of ERP Compass.

To improve the service

ERP Compass processes (personal) data to improve the service. To this end, ERP Compass uses data from which ERP Compass can determine how you use the website and which pages you visit.

Data that ERP Compass collects

ERP Compass processes personal data which can be traced back to an individual as well as data that cannot be directly traced back to a person, such as company data. In addition, ERP Compass processes further anonymized information about the use and function of the website.

Data that you provide:

If you complete a form via the website or otherwise provide personal data to contact ERP Compass, the personal data you provide, including your gender, name, e-mail address, telephone number, job title and address details, will be stored.

Personal data that you submit will be stored on a server of ERP Compass or on a server of a third party. If personal data are stored on a server of a third party, ERP Compass ensures that a processor agreement is concluded with this third party.

Data that ERP Compass collects through your visit to the website

ERP Compass obtains insight into the use of the website through tracking pixels and cookies. Screen tracking enables ERP Compass to improve the ease of use and user experience for the visitor.

Via the IP-tracking software of Leadforensics, ERP Compass determines which IP address from which the visitor uses the website. Based on this IP address, ERP Compass is able to obtain company information from the visitor through the Leadforensics software. The data that ERP Compass obtains via Leadforensics only concerns the generic e-mail address of a company, the website of the company, the company name and location. It is necessary for ERP Compass to process these data, obtained via the IP-tracking software of Leadforensics, to promote the necessary interests of ERP Compass, with the aim of using this data for direct marketing purposes.

How we process data

ERP Compass uses the collected data to provide services, to improve services or to develop new services. In addition, ERP Compass uses the data to comply with any legal obligations.

The data collected by ERP Compass will never be provided to third parties, unless the storage of the data takes place on third-party servers. ERP Compass has concluded a processor agreement with these third parties in which they commit to adequately securing the data to be processed by them. The processors engaged by ERP Compass are:

ERP Compass will never provide personal data outside the data listed in this privacy statement to third parties, unless you give explicit permission to do so or if ERP Compass is required to do so by virtue of a court order or statutory provision.

Software and/or cookies used

ERP Compass uses (online) software and/or cookies to analyse the use of the website. The following (online) software and cookies are used:

Leadforensics

Via the IP-tracking software of Leadforensics, ERP Compass determines which IP address from which the visitor uses the website. Based on this IP address, ERP Compass is able to obtain company information from the visitor by means of the Leadforensics software. The data that ERP Compass obtains via Leadforensics only concerns the generic e-mail address of the company, the website of the company, the company name and location.

Screen tracking

ERP Compass uses screen tracking via Mouseflow software (see: mouseflow.com/gdpr/) and VWO (see: vwo.com/platform/security-compliance/gdpr/) to gain insight into the use of the website. This enables ERP Compass to improve the ease of use and user experience for the visitor. The information obtained about the use of the website can never be traced back to a natural person, as Mouseflow and VWO completely anonymize all data obtained.

Google Analytics

ERP Compass uses the Google Analytics software to gain insight into the website traffic. ERP Compass does not collect any IP addresses through Google Analytics. The information collected by Google is anonymised as much as possible.

The data collected by Google Analytics is transferred to Google servers in the United States. Google meets the requirements set by the Privacy Shield and thus offers an appropriate level of protection.

ERP Compass uses the remarketing function in Google Analytics. By placing a cookie, ERP Compass can show visitors of the website an advertisement in the display network of Google at a later time. If you visit the website of ERP Compass, the number of ads displayed through the Google Analytics remarketing feature is limited to a maximum of five ad views.

Security

ERP Compass makes every effort to adequately secure personal data collected. ERP Compass has taken both technical and organizational measures to realize a sufficient degree of security of these personal data, given the nature of the personal data to be processed.

The website of ERP Compass is secured with an SSL certificate. All messages sent via the website are therefore sent to ERP Compass in an encrypted manner.

Period of storage

ERP Compass will delete all personal data after 18 months, unless the personal data are still considered necessary for the execution of an agreement. In addition, ERP Compass will retain the data for longer if it has a compelling reason to do so, in which case ERP Compass will inform the data subject.

Data obtained by ERP Compass via screen tracking are stored on the servers of ERP Compass for 6 months and then automatically deleted.

Data that does not concern personal information, such as company names, locations and websites, is stored for statistical purposes for an indefinite period. These data can never be traced back to a natural person.

Changes to the privacy statement

ERP Compass is entitled to make changes to this privacy statement at any time. If ERP Compass changes the privacy statement, you will be informed about this via the website of ERP Compass.

Your rights

Below you can read which rights you have and how you can exercise these rights in relation to ERP Compass. Data obtained by ERP Compass via third parties do not fall under the rights listed below. With regard to the personal data that third parties collect about you, you must exercise your rights directly towards these third parties, except for those cases in which these third parties have applied as processors.

Right to withdraw consent

If ERP Compass has obtained permission from you to process personal data, then you always have the right to revoke this consent.

Right of inspection and correction

You are always entitled to request access to the personal data collected about you. You also have the right to have the personal data processed by ERP Compass corrected (by ERP Compass).

Right to be forgotten

You have the right to request ERP Compass to delete all data collected about you. In principle, ERP Compass must comply with this request. In certain cases, another (legal) interest may outweigh the right to be forgotten, in the judgement of ERP Compass.

Right to submit a complaint

You have the right, if you cannot come to a solution through consultation with ERP Compass after a complaint, to file a complaint with the Dutch Data Protection Authority. You can submit your complaint in writing and send it to the following address:

Applicable law & other

Any legal disputes arising as a result of this privacy statement will only be presented to the Dutch court under the governance of Dutch law.

If ERP Compass is acquired by a third party or if ERP Compass merges with a third party, your personal data may be disclosed to this party. This party thereby obtains the right to continue to process your personal data as agreed in this privacy statement.
